- 12/23/2014: On November 20, 2014 President Obama announced plans under his Executive Order to expand DACA, create DAPA, among other various forms of relief. Remember that none of the forms of relief created are currently available. Please read this Consumer Alert (in English and Spanish).
- 9/30/2014: The Department of Health and Human Services allocated $9 million over two years for immigration lawyers to represent unaccompanied minors in immigration court. Read the full story.
- 9/24/2014: From the Washington Post: "I told Harvard I was an undocumented immigrant. They gave me a full scholarship."
- 9/3/2014: The Department of Homeland Security (DHS) extended the designation of South Sudan for Temporary Protected Status (TPS) for 18 months, from 11/3/14 through 5/2/16 and redesignated South Sudan to allow additional individuals to obtain TPS. Further, DHS extended the designation of Sudan for TPS for 18 months, from 11/3/14 through 5/2/16. Current TPS beneficiaries may re-register between 9/2/14 through 11/3/14.
- 7/23/2014: A settlement has been approved by the U.S. District Court for the Western District of Washington in the case of Duran Gonzalez v. DHS. The approved settlement means that certain individuals who were previously removed are still eligible for 245(i) relief if they filed their Adjustment of Status application along with a Form I-212 Permission to Reapply between August 13, 2004 and November 13, 2007. - 7/11/2014: USCIS has published an interim memorandum regarding H-1B petitions for nurses. This guidance is much needed, as previous guidance was 12 years old. Read the guidance here.
- 12/12/2013: Visa Bulletin for January 2014 is out. Highlights: EB-3 advanced 6 months with the exception of the Philippines (1 month) and India (no change).
- 12/04/2013: The King County Council has passed an ordinance that it will only honor ICE detainer requests for individuals that have been convicted, not simply charged, with serious, violent, sex and gun crimes, or two or more serious traffic (primarily DUI) offenses. - 11/15/2013: USCIS has issued a new "parole-in-place" memorandum, which addresses parole requests made on behalf of aliens present without admission or parole and who are spouses, children and parents of those serving on active duty in the U.S. Armed Forces. - 11/15/2013: USCIS has issued a reminder to Filipino nationals who have been impacted by Typhoon Haiyan that certain relief may be available including extensions and expedited services. Click here to read more.
- 08/20/2013: USCIS warns the public to be aware of common scams, such as telephone scams, "notario publico," and other scams regarding the unauthorized practice of law. See the full article here.
- 07/08/2013: The American Immigration Lawyers Association along with the Immigration Advocates Network and the American Immigration Council have compiled the preliminary results from a survey on Deferred Action for Childhood Arrivals (DACA). - 07/02/2013: The Department of Homeland Security published guidance for those seeking to file a Form I-130 petition for their same-sex spouse. http://goo.gl/vpsmH
- 06/28/2013: The U.S. Supreme Court recently struck down the Defense of Marriage Act ("DOMA"), which defined marriage as between a man and a woman. For immigration, this decision means that U.S. citizens who wish to petition for their foreign same-sex spouse may do so. At the 2013 American Immigration Lawyers Association ("AILA") Conference in San Francisco, Genesis Law Firm was present and witnessed USCIS Director Alejandro Mayorkas proclaim that USCIS will now begin to process I-130 petitions for same-sex beneficiaries. - 06/28/2013: The U.S. Senate passed their Comprehensive Immigration Reform Bill by a vote of 68-32. This bill will not become law until it passes the House of Representatives and is signed by the President. The bill faces a tough challenge in the Republican-controlled House of Representatives.
