• 03/29/2016: The Board of Immigration Appeals held today that direct sibling-to-sibling DNA test results reflecting a 99.5 percent degree of certainty or higher that a full sibling biological relationship exists should be accepted and considered to be probative evidence of the relationship. Matter of Ruzku, 26 I&N Dec. 731 (BIA 2016).
  
  Prior to this decision, such DNA results involving direct sibling-to-sibling relationship were not considered probative evidence, and in some cases, forced siblings whose parents were both deceased to provide other secondary evidence of the sibling relationship.
  
  
• 03/28/2016: The U.S. Court of Appeals for the 9th Circuit held 8 U.S.C. Sec. 1101(f)(i) unconstitutional. That section of the law states that a person who is a "habitual drunkard" lacks "good moral character." The court reasoned that, under the Equal Protection Clause, a person's medical disability (alcoholism) lacks any rational relation to his classification as a person with bad moral character. See Salomon Ledezma-Cosino v. Lynch (citation forthcoming).
  
  
• 03/09/2016: USCIS issued a Policy Memorandum today whereby the agency adopts the decision of Matter of H-V-P. In that case, the AAO concluded that in addition to primary care physicians, medical specialists who agree to practice in an area having a shortage of health care professionals may be eligible for the physician National Interest Waiver.
  
  
• 01/19/2016: The U.S. Supreme Court (SCOTUS) granted cert in the Obama administration's appeal of the 5th Circuit's decision to void the expanded DACA and DAPA programs. SCOTUS is expected to publish its opinion in June 2016. Until then, expanded DACA and DAPA remain a dream.
